INFORMATION PURSUANT TO ART. 13 OF EU REGULATION NO. 679/2016
In compliance with EU Regulation No. 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (herein after simply “EU Regulation” and/or “GDPR”), the company MORE TILE GALLERY BY UPTILES S.r.l., (C. f. e P. IVA: 03493760965) (herein after simply “UPTILES”), in the person of its legal representative pro tempore, with legal offices in Italy, in Finale Emilia (MO), Via San Lorenzo, 24/a, as Data Controller pursuant to articles 4 no. 7 and 24 of the EU Regulation, provides you, as the subject of the data processing pursuant to art. 4 No. 1 of the GDPR, with the following information pursuant to art. 13 of the EU Regulation.
In accordance with the principle of transparency pursuant to art. 5 of the GDPR, this policy provides the following information aimed at making you aware of the characteristics and methods used to process your personal data, by the data controller herein.
1. Nature and type of your data collected and processed by the data controller.
1.1. Your data, collected and processed by UPTILES – after you accessed the website www.moretilegallery.com (herein after the “Site”), following any request you may make to be contacted for any reason through the specific form on the Site, or after you have given your consent to receive sales and/or marketing notifications - fall under the category known as “personal data” pursuant to art. 4 no. 1 of the GDPR (“any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an on-line identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”), as well as under the category of so-called browsing data or so-called usage data (e.g. IP (internet protocol address), URL path (uniform resource locators) etc.).
2. Information about the data controller.
2.1. The data controller pursuant to article 4 no. 7 and 24 of the EU Regulation of your data described in the previous article 1.1 is the company, UPTILES, which can be contacted at the following address: info@uptiles.com
2.2. UPTILES informs you that any variations or updates on the data related to the subject as indicated in the previous article 2.1, will be duly published on the website.
3. Purpose of the processing.
3.1. In compliance with art. 5 paragraph 1 letter b) of the GDPR, your data will be collected and subsequently processed, by this data controller for the following purposes:
a. Complete and effective execution of your contact request;
b. Sending of communications in the broad sense for marketing (e.g. sending of advertising material, market research, sales communications) via automated methods (e.g. fax, SMS, email, MMS, recorded phone messages) or by less invasive contact methods (e.g. by post);
c. To gather statistical information, by the data controller, in an anonymous form about the use of the site.
4. Nature of consent.
4.1. The purposes outlined under letters a) and c) of the previous art. 3.1. fall within the principles of lawfulness pursuant to art. 6 paragraph 1 letter b) of the GDPR and, therefore, do not require your consent which, moreover, would be obligatory: to this end, UPTILES informs you that your refusal to consent to the processing purposes outlined in letters a) and c) of the previous art. 3.1. will make it impossible for UPTILES to correctly execute the tasks and powers assigned to it and directly or indirectly connected to the purposes in question.
4.2. The purpose outlined in detail under letter b) of the previous art. 3.1. falls under the circumstance indicated in art. 6 paragraph 1 letter a) of the GDPR and, therefore, requires your consent which is optional. To this end, UPTILES informs you that your refusal to consent to the purpose of processing outlined under letter b) of the previous art. 3.1. will not have any effect and/or consequence on UPTILES’s ability to fulfil the purposes outlined under letters a) and c) of the previous art. 3.1.
5. Recipients of your data collected and processed by the controller.
5.1. In compliance with art. 13 paragraph 1 letter e) of the GDPR, UPTILES informs you that your data described in the previous art. 1.1 may be communicated, for the sole and exclusive aim of fulfilling the purposes outlined in detail under letters a) and c) of the previous art. 3.1 to third parties (who, if the conditions set forth in the EU Regulations are met, will be specifically and promptly appointed, by the data controller herein, as Responsible pursuant to Articles. 4 no. 8) and 28 of the GDPR) based in Italy or within the European Union or in a so-called third country, with the exception of those considered inadequate by the European Commission, pursuant to art. 45 of the GDPR.
6. Data storage period.
6.1. In compliance with art. 13 paragraph 2 letter a) of the GDPR, UPTILES informs you that the period for which your data are stored described in the previous art. 1.1. will not exceed the period required to fulfil the purposes outlined in letters a) and c) of the previous art. 3.1. This period may be extended to fulfil legal obligations or ones possibly deriving from the need to manage a judicial or extrajudicial dispute brought by or against the data controller. Conversely, the storage period of your personal data outlined in the previous art. 1.1. for fulfilling the purpose outlined in letter b) of the previous art. 3.1. will last until you decide to revoke the relevant express consent, which may be extended to fulfil subsequent and hypothetical processing operations due to legal obligations or from the need to manage any extrajudicial or judicial dispute brought by or against the data controller.
7. Processing method.
7.1. UPTILES informs you that your data, outlined in the previous art. 1.1., will be processed by the data controller with electronic tools and/or stored on paper, IT and telematic supports in full compliance with Italian and European law.
8. Principles relating to the processing.
8.1. UPTILES informs you that your data outlined in the previous art. 1.1 will be processed in compliance with art. 5 of the GDPR.
9. Data subject’s rights.
9.1. We also inform you that, under articles 15 to 21 of the GDPR, you have the right to exercise the rights, relating to your personal data described in art. 1.1.
9.2. In compliance with art. 12 paragraph 1 of the EU Regulation, the data controller undertakes to provide you with any communication under articles 15 to 22 of the GDPR in concise, transparent, intelligible and easily accessible form, using clear and plain language,: this information will be supplied in writing or by other means, including electronic means. When requested by the data subject, the information may be provided orally, provided that the identity of the data subject is proven by other means.
9.3. In compliance with art. 12 paragraph 3 of the EU Regulation, the data controller informs you that it undertakes to provide information on action taken on a request under articles 15 to 22 without undue delay and in any event within one month of receipt of the request. That period may be extended by two further months where necessary, taking into account the complexity and number of the requests.
9.4. You may use the contact data specified in the previous article 2 to exercise the rights outlined above in this article.
